DMCA Policy

Kinward, Inc. ("Porchside") respects intellectual property rights and responds to notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA). This Policy describes how to submit a notice, how we handle notices, and how to reach us about a listing we published from a public source.
1. Reporting Infringement
If you believe content on the Service infringes a copyright you own or control, send a written notice to our designated agent that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material claimed to be infringing and information reasonably sufficient to locate it, such as a link or a screenshot with the name of the activity, community, or member; (4) your name, address, telephone number, and email address; (5) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on its behalf. Please note that under 17 U.S.C. section 512(f) you may be liable for damages if you knowingly misrepresent that material is infringing.
2. Designated Agent
Send notices to our designated copyright agent, Kinward, Inc., Legal, at support@porchside.co with the subject line "DMCA Notice", or by mail to Kinward, Inc., Austin, Texas. A notice sent to any other address may not be processed.
3. Our Response
On receiving a notice that substantially complies with section 1, we remove or disable access to the material and take reasonable steps to notify the member who posted it, where there is one, including the reason and a copy of the notice with your contact details included as the statute contemplates. Where the material is a listing we published from a public source rather than content a member posted, we remove the listing and there is no member to notify.
4. Counter-Notification
If you believe your content was removed by mistake or misidentification, you may submit a counter-notice to the same address that includes your signature, identification of the removed material and its prior location, a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification, your name, address and telephone number, and your consent to the jurisdiction of the federal district court for your district (or, if you are outside the United States, for any district in which we may be found) and to accept service of process from the person who filed the notice. We forward your counter-notice to the complainant and may restore the material in 10 to 14 business days unless the complainant notifies us that they have filed a court action.
5. Repeat Infringers
We maintain a policy of terminating, in appropriate circumstances, the accounts of members who are the subject of repeated valid infringement notices, and we may terminate an account for a single serious infringement. We keep a record of notices received and of the action taken.
6. Listings Published From Public Sources
Some listings on the Service describe public events and are created by us from publicly accessible sources, as our Terms of Service explain. If you are the organizer of such an event, or the operator of a source, and you want a listing removed or corrected, you do not need a formal notice: email support@porchside.co with a link to the listing. We will remove it promptly once we can reasonably confirm the request comes from you or someone authorized to act for you. You can also use the notice process above.
